1. Agreement to Terms

By accessing or using Homer (“the Service”), operated by Kinetic Labs Inc. (“we,” “us,” or “our”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Homer is an AI-powered apartment hunting assistant. The Service monitors rental listings, scores them against your preferences, drafts outreach emails to landlords on your behalf, and helps schedule apartment tours—all through a conversational interface.

3. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use the Service. By using Homer, you represent that you meet these requirements.

4. Accounts

You may begin using Homer anonymously. To access premium features, you must create an account by verifying your phone number. You are responsible for maintaining the security of your account and for all activity that occurs under it.

5. Subscriptions and Payment

Homer offers a free tier with limited functionality and a paid subscription (“Homer Pro”) at $29 per month. Paid subscriptions are billed monthly through Apple In-App Purchase or Stripe. You may cancel at any time; cancellation takes effect at the end of the current billing period. Refunds are handled in accordance with the applicable payment platform’s policies.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or to violate any applicable laws or regulations
• Attempt to interfere with, compromise, or disrupt the Service
• Scrape, reverse-engineer, or extract data from the Service beyond normal use
• Impersonate another person or misrepresent your identity or affiliation
• Use the Service to send unsolicited bulk communications or spam

7. Outreach on Your Behalf

Homer may draft emails to landlords or property managers on your behalf. These emails are never sent without your explicit approval. You are responsible for the content you approve and send through the Service.

8. Listing Data

Homer aggregates publicly available rental listing information from third-party sources. We do not guarantee the accuracy, completeness, or availability of any listing. Listing data is provided “as is” and may be outdated or inaccurate. Always verify listing details independently before making rental decisions.

9. AI-Generated Content

Homer uses artificial intelligence to generate recommendations, scores, and draft communications. AI output may contain errors or inaccuracies. The Service does not provide legal, financial, or real estate advice. You should exercise your own judgment in all rental decisions.

10. Intellectual Property

The Service, including its design, software, and content (excluding user-generated content and third-party listing data), is owned by Kinetic Labs Inc. and protected by applicable intellectual property laws. You retain ownership of any content you submit through the Service.

11. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

12. Limitation of Liability

To the maximum extent permitted by law, Kinetic Labs Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

13. Termination

We may suspend or terminate your access to the Service at any time for any reason, including violation of these Terms. You may terminate your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a revised effective date. Continued use of the Service after changes constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of laws principles.
